The Key Procurement Issues For The Client Construction Essay The purpose of this report is to analyse the key procurement issues for the Client Cinnamon Grand and to further evaluate the Clients objectives. Analysis of Clients objectives will be evaluated to provide a better understanding on the project issues and main concerns, which includes an analysis of the various procurement routes such as the Traditional Route, the Design Build Route and the Management Route to weigh the most suitable route to suit the Clients objectives. The report will allow the Client to make a better choice in selecting the best procurement route based on the recommendations discussed. This includes the advantages, disadvantages and risks involved for the 3 main procurement routes based on Clients objectives. It will identify issues on the project requirements on quality, time and costs ensuring the Clients objectives are met. INTRODUCTION The Client owns a large chain of hotels called Cinnamon Grand. The hotels provide guests with comfortable accommodation throughout the UK. Their main business includes adopting neglected historical landmarks and refurbishes the building to their former magnificent look. Although the Client is experienced at renovation of historical buildings, the Client does not have much experience in re-constructing damaged buildings or alteration works to the structures of the building. The project objective is to re-construct 3 Hotels, damaged by a period of bad weather and severe storms to an existing hotel quality or better. These Hotels are located in prime locations in town settings which means time is of the essence. For phase 1, time is the main priority due to the prime locations of the hotels. The opportunity cost will be incurred if there are any delays in phase 1. For phase 2, issues raised are the quality of the facilities and to ensure there is none or minimal disruption to the business. As the Consultant to the Client, we will discuss the 3 main procurement routes which are the Traditional Route, the Design Build Route and the Management Route and analyse the best route based on the Clients objective. CLIENTS OBJECTIVES Client is concern about the duration of the project and its quality. Internal facilities must be upgraded and reconstruction of building must preserve the historical outlook of the existing building. Although the Client has experience in renovation works, the current project development includes the demolition of structures and re-construction of hotels both external and internally. Projects done by Client previously is different in nature, one being renovation works, minor construction works and current is a complex re-construction and refurbishment of the damaged hotels. The project consists of 2 (two) phases:- Phase 1 is to re-construct the hotels outlook and structures and completing key areas for operation which are the Roofs, Guest Rooms, Restaurant and Swimming Pools. Expected date of possession of site by contractor is 1st Mar 2014 and expected construction completion date is 28th February 2015, a 1 year construction. Planned re-opening on 1st April 2015. Phase 2 is to enhance the hotels with new facilities such as Dance Studios, Health Fitness Centre, Conference and Meeting Rooms without any disruption to hotel operations. The Client is very concern about the duration of the project due to the location, a prime town setting which means, if the hotels completes early, the losses incur from no business days or opportunity cost will be lesser. The second concern is the quality of the building. Outlook must be the same as before being damaged, structurally must be improved to increase building total life cycle. While time and quality is of the main concern, the cost of the project must not exceed the budget of $120 million pounds for total of 3 hotels. The cost certainty must be known earliest possible. PROCUREMENT ISSUES The procurement issues are listed below:- No in-house executive by the client, means the Client have to engage consultants to oversee the project. Highly concerned about possible project delays and overrun of costs. Financial loan of $120 million pounds acquired for project. This means there is a tight budget, so cost certainty is required before the construction begins. Works in phase 2 must be done quickly to minimise the discomfort to guests. Quality of building should be high and sensitive to ensure the dignity of the building and services provided are not compromise. Every procurement route have its main priorities, no procurement can accommodate to the three main factors which are Time, Cost and Quality. PROCUREMENT ROUTES Traditional route: in this route the Client appoints a team of consultants to design and prepare tender documents. The process is in sequence as shown in Fig 1. The selection of a main contractor is done later through tendering. Fig 1 Advantages are the competitive tendering, low preparation cost for tendering, procedures are known widely and variations are easily arranged. Disadvantages are mainly the long timeline, no concurrent work at site, incomplete design results in less certainty, poor build-ability due to contractor not involved during design stage, risk by Client for the design. Risks on cost are low due to lump sum contract and there is a fixed contract date with exception that contractor claims extensions. Since the design is designed by the consultants, there is low design and quality risk. Although the Traditional route is sequential, there are 2 other variations. They are the traditional accelerated and traditional with re-measurement. For the Traditional accelerated, the contractor is appointed earlier based on partial design and brief through negotiation or competitive tendering. Traditional routes focus on the cost and the quality of the project. In this case, for the current project, time is of the essence. Traditional route is not suitable for the project. Design and Build route: in this route a main contractor is appointed to design and construct the project. This route integrates design and construction which means, the construction works are concurrent even before final design is completed as shown in Fig 2. This quickens the timeline of the project. Fig 2 Advantages of this route are the client liaises with a single point of communication and responsibility. The price certainty is known before the construction starts. The total project duration is shorter than in the traditional route as works are done concurrently with design. Disadvantages are there is no design overview because it is designed by the contractor. The design brief by client must be adequate and the bid through tender is difficult to compare. Changes made by client can be expensive. Risk on cost and time are low as it will be on a lump sum basis and works are done to a fix time. There is a high risk in design and quality as the contractor controls the design and some contractors do not have the capacity to carry out the proper design. Although the design is mostly done by contractor, variants such as Develop construct can be considered to improve design. In develop construct route the employer appoints a consultant at the initial stage to develop a detailed design to have more control on the design. Assuming the Client have the detailed design drawing for the existing building, this option is the most suitable for the project. Management route: this route consists of 2 variant, The Management Contracting and The Construction Management route. In this route, the Client appoints the Management Contractor at an early stage where they help to design and contribute management expertise. The appointments of sub-contractors/specialist contractor are decided by both the Client and Management Contractor before work commencement in packages, as shown in Fig 3. Fig 3 Advantages are the work packages of specialist contractors are competitive, due to the concurrent works, timeline will be quickened. Late changes can easily be accommodated and the relationship between the Client and the Management Contractor is much closer than in traditional. Disadvantages are the cost prediction, the need for a good project team and a quality brief. The design must be managed properly to ensure work packages is kept on programme. Risks are low for design and quality due to close link between client and contractor but medium risk for cost and time as the amount is known after the last package is let. This route is longer compared to design and build and require a good history between client and contractor. RECOMMENDATIONS Based on the Clients objectives, the Design Build variant (Develop Construct) is the most suitable for the project. This procurement route does not need an in-house executive as a consultant will be in-charge of developing the design of the project. Assuming Client has the design of the existing 3 hotels, the design for the structure is acquired and project can commence as early as a contractor is appointed, shorter timeline. The cost of the project will be known before the work commences and the quality of building will not be compromise due to existing design by Client and additional inputs by the design team for the phase 2 of the project. The quality of phase 2 will be based on design worked by the Client specifications and the design team, ensuring good quality facilities.

During the course of the pilgrimage and while circumambulating the Ka'bah, Fatima felt the pangs of childbirth.She retired to a secluded place in the precincts of the holy Ka'bah, and there Hadrat Ali was born. Hadrat Ali has thus had the unique honour to be born in the House of God. When both mother and the child returned home, the holy Prophet, and Hadrat Khadijah came to see her newborn child. Since his birth, he had not opened his eyes, and that worried both Fatima and Abu Talib. However, when the holy Prophet took the child in his lap, then he opened his e yes. [4][6][24] For the ten years that Muhammad led the community in Medina, Ali was extremely active in his service as his secretary and deputy, serving in his armies, the bearer of his banner in every battle, leading parties of warriors on raids, and carrying messages and orders. 25] As one of Muhammad's lieutenants, and later his son-in-law, Ali was a person of authority and standing in the Muslim community. Ali first distinguished himself as a warrior in 624 at the Battle of Badr. He defeated the Umayyad champion Walid ibn Utba as well as many other Meccan soldiers. According to Muslim traditions Ali killed between twenty and thirty-five enemies in battle, most agreeing with twenty-seven. 33] Ali was prominent at the Battle of Uhud, as well as many other battles where he wielded a bifurcated sword known as Zulfiqar. [34] He had the special role of protecting Muhammad when most of the Muslim army fled from the battle of Uhud[1] and it was said â€Å"There is no brave youth except Ali and there is no sword which renders service except Zulfiqar. â€Å" [35]He was commander of the Muslim army in the Battle of Khaybar. [36] Following this battle Mohammad gave Ali the name Asadullah, which in Arabic means â€Å"Lion of Allah† or â€Å"Lion of God†. Ali also defended Muhammad in the Battle of Hunayn in 630. 1] Life after Muhammad (during the reign og the 3 caliphs) Another part of Ali's life started in 632 after death of Muhammad and lasted until assassination of Uthman Ibn Affan, the third caliph in 656. During these years, Ali neither took part in any battle or conquest. [4] nor did he assume any executive position. He withdrew from political affairs, especially after the death of his wife, Fatima Zahra. He used his time to serve his family and worked as a farmer. Ali dug a lot of wells and gardens near Medina and endowed them for public use. These wells are known today as Abar Ali (â€Å"Ali's wells†). 60] He also made gardens for his family and descendants Ali did not give his oath of allegiance to Abu Bakr un til some time after the death of his wife, Fatimah. [4]Ali participated in the funeral of Abu Bakr but did not participate in the Ridda Wars. [63] He pledged allegiance to the second caliph Umar ibn Khattab and helped him as a trusted advisor. Caliph Umar particularly relied upon Ali as the Chief Judge of Medina. He also advised Umar to set Hijra as the beginning of the Islamic calendar. Umar used Ali's suggestions in political issues as well as religious ones. 64] Ali was one of the electoral council to choose the third caliph which was appointed by Umar. Although Ali was one of the two major candidates, but the council's arrangement was against him. Sa'd ibn Abi Waqqas and Abdur Rahman bin Awf who were cousins, were naturally inclined to support Uthman, who was Abdur Rahman's brother-in-law. In addition, Umar gave the casting vote to Abdur Rahman. Abdur Rahman offered the caliphate to Ali on the condition that he should rule in accordance with the Quran, the example set by Muhamma d, and the precedents established by the first two caliphs. Ali rejected the third condition while Uthman accepted it.According to Ibn Abi al-Hadid's Comments on the Peak of Eloquence Ali insisted on his prominence there, but most of the electors supported Uthman and Ali was reluctantly urged to accept him. [65 Election as Caliph as soon as Uthman died, all eyes turned to Ali. The companions of the Prophet could not think of anyone else, to restore peace, and law and order to the Dar-ul-Islam which was battered by economic and social conflict. All the leading Muhajireen and Ansar, therefore, gathered in the Mosque of the Prophet, and agreed, at a caucus, to ask Ali to take charge of the government, and to steer the ship of state to safety.A delegation then called on Ali, and requested him to accept this responsibility. Ali, however, did not accept the offer of the companions, and said that he preferred to be an adviser rather than the caliph. But the companions insisted and told him that there was no other capable of it. But Ali was not eager to grasp this opportunity as he knew that the caliphate was not to be taken with its roses and its thorns, the roses were all gone and all that was left were thorns. So basically accepting the caliphate would only mean wearing a crown of those thorns.Ali knew that if he accepted the caliphate his reign would begin with a civil war, which was not an auspicious beginning. Ali wanted to rebuild the infrastructure of the Islamic society or to bring it back as just as it was in the times of Prophet Muhammad but he realized that he could do so only in the most determined opposition from Quraish. Ali considered all of this and therefore was not willing to take over the caliphate. However at last after great insist from the companions Ali accepted the proposal on the condition that he will put the commandments and prohibitions of Allah and his messenger before everything.

Responsible Social Networking Campus gossip websites were ideally intended to be used as a way to communicate with students and engage with peers in useful ways. I feel that campus gossip websites are being used unethically. Currently, Campus gossip websites are just now being utilized to start rumors and anonymously publicly bash fellow students without ramifications from school and related officials. In turn, the students have gone to new extremes with malicious comments towards fellow peers and in some cases, causing physical and emotional damage with no clarity on who all should be held liable.A waste of time and energy is spent by students anonymously involving themselves in these gossip websites who knowingly hold such power to destroy a fellow peer and yet people still use them in all the wrong ways. It is completely unethical to post a rumor about another individual on a campus gossip website. There are standards that every person should hold themselves to and in return be ab le to treat one another as you would like to be treated. College should not be a place where students are more concerned about social statuses and stressed about being publicly humiliated by peers because of one person’s post on a campus gossip website.Cruel, hurtful comments tend to follow, making campus life for the targeted individual agonizing. Ethical conduct should be carried out day to day, through out every aspect, even when socially it can be easy to stray if you are constantly subjected or surrounded around peers who chose not to. It still gives no excuse to contribute to gossips websites. It’s simple, know right from wrong and conduct yourself in that manner, posting rumors on gossip websites results in nothing but unethical. If I were to read about myself in a posting on a gossip site of course, I would first feel the need to defend myself.Depending on the severity of the information that was posted, I know my first thought would be who did this and what th is person’s intent behind doing so. The thought of having someone have such a negative opinion about you is very depressing. Everyone always wants nothing but positive things to be said when your name is mentioned. My train of thought would be to fight back, say something in response to let this person and everyone else know that what’s being said is nothing but someone’s personal attack for some unknown reason to publicly degrade me.My actions, on the other hand, would not reflect any of that. I have been in situations where I have read some harsh critics opinions and peers personal thoughts of what they thought of me and/or current status socially and acted on my first defensive thought strategy. The result never ended where my first intentions wanted to. Looking back after taking the time to calm down, reading both of our comments, I realized that I made myself look just as unethical as the person posting about me. I was getting drawn in, feeling like I had t o respond back by using personal attacks to feel justified.Not responding and by not contributing in any form is what needed to be done. Of course, my feelings would be dishearten but overall I would know what I did was right by not having to be unethical as a form to feeling justified to prove them wrong. As of right now, schools administrators and even federal law cannot fully regulate or hold certain parties responsible who are at fault for these campus gossip websites. Ethically, of course this is not right. We are taught as children, that there are consequences for our bad choices.There are laws that we are to follow and if we do not, you will be held accountable and punished. So how is it that so many people have been hurt and suffered some mental distress and in some cases unfortunately, physical harm and damage? As discussed in* a case raised question whether colleges should be obligated to intervene when one of their students are targeted on a gossip website. A very concern ed mother addressed an issue with the Dean at the University where her daughter attended because some explicit names where posted on a campus gossip website under her name.After the Mother was told nothing could be done by the University to block or remove the comments, she then decided to file a complaint with the U. S Department of Education’s Office for Civil Rights stating the University was required to take action under Title IX, Federal Gender-Equity Law arguing that it interfered with her daughter’s ability to learn. After they reviewed the case, they ruled that because the comments were posted anonymously and not able to be proved students, and because the Mother did not identify her daughter by name to the University so they could properly investigate further, nothing was done.Certain steps needed to be followed like the daughter reporting the conduct to the campus police. Her representation stated it was not all a loss. The Department’s willingness to consider the complaint means that gossip websites fall under Title IX guidelines meaning in turn, more questions would have to be answered and hopefully, long term, Law and Regulations can be better stated and put into place. * Something needs to be done to hold certain parties responsible. So it is unethical that nothing is being done to stop this ongoing issue that has hindered many students.Sadly enough, cyber bullying and gossip websites has become severe enough to be lead to rape, murder and suicides. As talked about in*(http://topics. nytimes. com/top/reference/timestopics/people/c/tyler_clementi/index. html) a Rutgers University freshman Tyler Clementi committed suicide after his roommate decided to live stream his intimate encounter broadcasting on twitter encouraging to watch and revealing to everyone that he was gay. He then was ridiculed as he turned into the dorm’s gossip.Tyler, a very quiet, reserved young man never spoke of his sexual orientation so you can imag ine the extreme distress and humiliation that followed and unfortunately, 3 days later he decided to jump off the George Washington Bridge into the Hudson River in an apparent suicide. There were 2 people charged in this case and in my own personal opinion, lightly and not even in relation to the suicide but more along the lines invasion of privacy. The case questioned Hate crime due to the sexual orientation and his roommate exploiting Tyler, prosecutors stating that his roommate was homophobic.There are many more cases like this maybe some not as extreme but how is it that people are getting no ramifications, no punishment what so ever for their mean attempt to harass, mortify and viciously attack peers leading to crimes in due result of anonymously posting on a gossip website. In this case Tyler’s was documented and more publicly noted by his roommate making charges easier but still not enough in regards to cyber bullying and being held accountable and who all should be pu nished.Responsibility to crimes in due result of a posting on a gossip website first and foremost the person responsible doing the act needs to be held accountable, the victims school if proper steps were not taken by the victim to notify proper officials to try to prevent the crime, and the website host should also be held accountable for letting people post such things that could in turn, lead to something as severe as a crime as a result of. Postings should be monitored and everyone should be under certain guidelines for this reason of crimes taking place.As Technology advances, we have to be constantly changing, learning and adapting to be able to communicate anywhere we go. To be able to attend College, it is almost impossible to be able to be successful without a computer, cell phone and internet. Having such access to information, constantly online talking with peers and other social outlets has become the majority of communication. In today’s culture, people spend mor e time on a computer than anything else and as technology advances, everyone feels urged to keep up with it due to its improvements to make day to day tasks as simple as possible, instant gratification to any task at hand.This influences our culture in many ways but in the case of how it affects the overall scheme of campus gossip websites, you can only imagine how easy it is to access this information and how easy it is instantly post. I think technology advances are meant for much more then to able to get on Facebook and post what you had for lunch but having such easy access to this gives campus peers way to gossip more freely. Word of mouth takes much longer as to posting online where you know it’s going to be seen in a matter of seconds. In conclusion, campus gossip websites are unethical.Posting rumors, spreading lies regardless of your personal opinion about someone, in no way shape or form, is going to accomplish anything positive for either person involved. Having to find any information about yourself is upsetting enough but to have to deal with it on a daily basis where more concern should be about education, not about being ridiculed or embarrassed by what someone post stated. Standards and laws need to be put in place to better protect students from being put in the situation where cyber bullying and posting anonymously goes unpunished by holding schools, the posting party and web host.
